All MULTI-DEX DERBIT OLIVINE CONTRACTS ARE SUBJECT TO THE FOLLOWING WARRANTY
Multi-Dex undertakes to repair within a reasonable time after receipt of notice from you or your architects, and without further charge, any leakage which may occur in its waterproofing treatment, and proved due to bad workmanship or waterproofing or waterproofing material. Fair wear and tear and leakages accasioned by abnormal causes or agencies excepted. The foregoing undertaking holds good for a period of 10 years (as stated in our quotation) from date of completion.
This company also undertakes to advise all clients to their registered business address of scheduled maintenance requirements in terms of the original contract. It is of course clearly and distinctly understood that no liability of any nature whatsoever will attach to Multi-Dex unless and until it has been called upon to repair leakages in terms of the aforegoing warranty. This warranty is subject to and conditional upon payment in full being received by Multi-dex when due. It becomes null and void if and when Multi-dex waterproofing treatment is interfered with by a third party.
This warranty becomes null and void should the surfaces be subjected to traffic of any kind, trafficable surfaces excepted. In no circumstances however, including negligence by Multi-Dex or its employees, shall Multi-Dex be responsible for indirect or consequential damages or losses. If Roof gardens, walls, pavings or other structures or materials have been built or laid upon or over our waterproofing, whether by us or by others, the building owner shall, at his own expense be responsible for their removal and/or replacement in the event of repairs to the waterproofings becoming necessary.
THIS IS THE ONLY WARRANTY, EXPRESSED OR IMPLIED, BINDING MULTI-DEX
THIS WARRANTY HOLDS GOOD FOR ONE YEAR FROM DATE OF COMPLETION OF ITS WORK. IT IS SPECIFICALLY PROVIDED THAT IN THE EVENT OF MULTI-DEX Work NOT PROVING SATISFACTORY BY REASON OF INHERENT OR LATENT DEFECTS IN THE SURFACE OR STRUCTURE, IT SHALL INCUR NO LIABILITY OF ANY NATURE WHATSOEVER IN RESPECT OF ITS WORK.
